A jurat is used when a signer swears to the truth of a document’s contents. The notary must administer an oath or affirmation and witness the signer’s signature. The jurat wording “subscribed and sworn to before me” confirms that the document was signed (“subscribed”) and an oath or affirmation was given (“sworn”) in the notary’s presence (“before me”). California notaries cannot choose the notarial certificate for a signer, as that would be practicing law. A notary public may only ask which form the signer wants; if the signer is unsure, the signer must contact the document’s originator.

An acknowledgement verifies the signer’s identity and confirms they willingly signed the document. The signer is not swearing to its truthfulness.
